Banking While Intoxicated: No Such Law, Says HSBC In Response To Rizer Lawsuit

HSBC bank says there is no law against Banking While Intoxicated, as alleged in a multi million dollar claim by supermodel Maggie Rizer.

HSBC is the major defendant in a nearly $24 million lawsuit filed by Rizer against numerous parties for her losses of up to $7 million.

Rizer alleges the bank was negligent in allowing her stepfather John Breen, who held Power Of Attorney over her accounts to withdraw large amounts of money for his personal use.

The lawsuit alleges Breen would often make the withdrawals while in an intoxicated condition.

In its motion for dismissal of the claim, HSBC's attorneys note: "In a desperate move, Plaintiff makes the unique and salacious allegation that her attorney-in-fact was banking while intoxicated and thus, some sort of duty arose on the part of HSBC as a result."

The motion goes on to say, "HSBC has no duty to screen its customers for use (of) alcohol or any other substance. There is no law prohibiting banking while intoxicated or while using medication. To hold that such a duty exists would place an unreasonable, and illogical duty upon banks. Mr. Breen's alleged intoxicated state is simply irrelevant."
